GreenGo appeal: Council of State confirms preliminary agreements as a valid title for PAS submission
A landmark ruling strengthens legal certainty for renewable energy development in Italy
With Judgment No. 9891/2025, filed on 15 December 2025, the Italian Council of State upheld the appeal brought by Ecolux Srl, a GreenGo SPV, affirming a principle of central importance for the development of renewable energy projects in Italy.

The Court clarified that preliminary agreements constitute a valid legal title for the submission of a PAS, provided they grant the prospective purchaser the powers necessary to immediately carry out the activities required for the authorisation process.
This ruling strengthens legal certainty and operational clarity for renewable energy developers across the country.
